ABLE Accounts (IRC §529A)

Tax-advantaged savings accounts for people with disabilities, allowing accumulation of funds for disability-related expenses while preserving favorable SSI and Medicaid treatment. Effective January 1, 2026, eligibility includes individuals whose disability or blindness began before age 46. The 2026 annual ABLE contribution limit is $20,000, with additional compensation-limited contributions allowed for some working beneficiaries.

What it offers

ABLE accounts are tax-advantaged savings accounts for qualified disability expenses such as education, housing, transportation, employment training, assistive technology, health, financial management, legal fees, oversight, funeral/burial, and basic living expenses. In 2026, an eligible individual may qualify when disability or blindness began before age 46. Contributions from all sources are generally limited to $20,000 in 2026. A working beneficiary may make additional contributions when certain retirement-plan contributions were not made for the tax year; SSA's 2026 ABLE guidance lists the extra contribution cap as the lesser of employment earnings or $15,960 in the contiguous states/DC, $19,950 in Alaska, or $18,360 in Hawaii. SSA disregards the first $100,000 in an ABLE account for SSI resource purposes. Medicaid payback and investment menus are state-plan terms, so caregivers should review the selected state ABLE program disclosure.

Questions that decide eligibility

GiveCare prepares the questions; the program makes the decision. Bring these to the call or the application:

  1. 01

What are the current income and asset limits, and whose income counts?

  2. 02

What counts as a qualifying disability or level of care need, and what documentation shows it?

  3. 03

Does the VA disability rating meet the program’s minimum (our record lists null%)?

  4. 04

Do the work hours meet the minimum (our record lists null hours)?

  5. 05

Is there a caregiver-specific department, coordinator, or support line? Ask for it by name.

Many agencies have one that isn’t advertised on the website.

  6. 06

What documents do you need from us to start an application?

  7. 07

Is there a waitlist right now, and how long is it?
